Terms and conditions

These terms are the agreement between you and Formelia when using the platform. We wrote them to be understood on first read: what you can expect from us, what we expect from you, and what happens in the hard cases.
The essentials
- Your forms and their responses are yours. You grant us only the technical permissions needed to operate them.
- You are responsible for what you ask and for complying with the law towards your respondents; we process on your behalf.
- No phishing and no collecting passwords or card numbers: we take down forms that do.
- Paid plans renew monthly through Polar and you can cancel anytime; the plan stays active until the end of the paid cycle.
- AI results are drafts: review them before you use them.
- The service is provided as-is, with liability capped at what you paid us in the last 12 months.

Acceptance and who can use Formelia
By creating an account or using Formelia you accept these terms and our Privacy policy. If you disagree with something, do not use the service; if you have questions, write to us first.
- You must be at least 16 years old to create an account.
- To purchase a paid plan you need legal capacity to enter into contracts.
- If you use Formelia on behalf of an organization, you represent that you can bind it to these terms; in that case, "you" includes that organization.
The service
Formelia is a platform to create forms, share them with your brand and analyze responses, with optional artificial intelligence features. The details of each plan (limits, features and prices) are on the pricing page and form part of these terms.
Formelia is an evolving product: we improve and adjust features continuously. When a change materially reduces something you pay for, we will give you reasonable advance notice.
Your account
- You are responsible for keeping your credentials confidential and for all activity performed with your account.
- Registration information must be truthful and kept up to date.
- Notify us immediately at legal@formelia.io if you detect unauthorized access.
- You may not transfer or sell your account, nor use multiple accounts to evade Free plan limits or the monthly free quota.
Your content and your responses
Everything you create or receive in Formelia — forms, copy, brand images and your respondents' answers — is yours. We claim no ownership over it.
To operate the service you grant us a limited, worldwide, non-exclusive license to host, process, transmit and display your content, only to the extent necessary to provide the service to you (for example, showing your form to a respondent or computing your statistics). This license ends when you delete the content or your account, except for remnants in backups during their rotation cycles.
- You are responsible for your content: for having the rights to use it and for ensuring that what you ask and publish complies with the law.
- On the Free plan, forms display a Formelia badge; on paid plans you can remove it.
- We are not obligated to retain content after account deletion or service termination beyond what the Privacy policy states.
Acceptable use
Formelia exists to collect honest answers from people who chose to give them to you. It is prohibited to use the platform to:
- Phish or impersonate: pose as another person, company or service, or imitate their pages.
- Collect passwords, login credentials, full payment card numbers, security codes or equivalent banking data.
- Collect special categories of data (health, biometrics, religion, sexual orientation, ethnic origin, etc.) without a legal basis and the person's explicit consent.
- Publish content that is illegal, defamatory, exploits minors, promotes violence or hate, or infringes third-party rights.
- Send spam or unsolicited mass contact using data collected with Formelia.
- Distribute malware, malicious links or any attempt to compromise respondents' devices.
- Interfere with the service: probe or breach its security, access other people's data, overload the infrastructure or scrape at scale.
- Resell or sublicense the service without our written agreement.
- Evade plan limits or abuse the monthly free quota (for example, with repeated accounts or organizations).
- Access the service to build a competing product or publish performance benchmarks without our written consent.
We may review forms flagged by reports or by our systems — and the content submitted through them, including files uploaded by respondents — and, if they violate these terms or the law, unpublish them, remove them or suspend the account. In severe cases (fraud, phishing, risk to others) we will act without prior notice. If you believe a form or content hosted on Formelia violates these terms or infringes your rights (including intellectual property), report it to legal@formelia.io with the information needed to locate it; we will remove it where appropriate.
Your respondents and data protection
For the personal data of the people who answer your forms, you are the data controller and Formelia acts as processor, handling it under your instructions and the Privacy policy. This means it is up to you to:
- Have a legal basis for each piece of data you request, and obtain any consents your legislation requires.
- Tell your respondents who you are and what you will use their data for.
- Handle your respondents' requests about their data (access, correction, deletion); we will assist you with the product's tools.
- Not request data that these terms prohibit collecting.
If your organization needs a data processing agreement (DPA), request it at privacy@formelia.io.
Plans, payments and AI credits
- Prices are in US dollars (USD) and billing is monthly, renewing automatically until you cancel.
- Payments are processed by Polar as merchant of record: it handles the charge, applicable taxes for your country and receipts. Formelia does not store card data.
- The purchase is made through Polar and is also governed by its purchase terms and refund policy; regarding the payment process, those prevail.
- If you start an unjustified payment dispute, we may suspend the account while it is resolved.
- Taxes are calculated and shown at checkout.
- You can upgrade at any time; changes are handled through the billing portal. Downgrades apply at the end of the current cycle.
- Included AI credits renew each cycle and do not roll over month to month. Credits have no monetary value and are not redeemable or transferable.
- The monthly free quota of AI credits is granted once per user and renews every month; unused credits do not roll over and we may revoke it in cases of abuse.
- Extra credits (overage) are strictly optional: they are only charged if you enable them, at the published price and up to the cap you define.
- If a charge fails, we will notify you and retry; if unresolved, your plan moves to Free and its limits apply. Your content is not deleted, with one exception: Free applies a 90-day response retention, so responses older than 90 days will stop being available as described in the Privacy policy. Export your responses first if you want to keep them.
- Payments made are non-refundable, except where the law of your country provides otherwise or an error on our side justifies it.
- We may change prices; any change will be announced at least 30 days in advance and will never apply retroactively to a cycle already paid.
Cancellation and downgrades
- You can cancel your subscription anytime from billing settings; the plan stays active until the end of the paid cycle.
- When you downgrade we delete nothing: you keep access to your content and your responses. The new plan's limits apply going forward: you will not be able to publish forms above its limit, and receiving responses is subject to its quotas and its retention policy (90 days on Free).
- On the Free plan, responses are retained for 90 days from receipt (see Privacy policy).
- You can export your responses before cancelling or downgrading; we recommend doing so.
Artificial intelligence features
AI features (form generation, response insights) produce automated results from your instruction and your content. Treat them as a good draft, not a finished truth:
- Results may contain errors, omissions or bias. Review and edit them before publishing or making decisions with them.
- You are responsible for how you use the results, including verifying they do not infringe third-party rights or your industry's rules.
- Underlying models and providers may change; we aim to maintain or improve quality, we do not guarantee identical results over time.
- Credit consumption per operation depends on the size of the content processed.
Formelia's intellectual property
The platform — software, design, brand, logos and documentation — is owned by Formelia or its licensors. These terms transfer no rights over it to you, other than using the service according to your plan.
If you send us suggestions or ideas about the product, we may use them freely to improve it, with no obligation of compensation or attribution.
Availability and changes to the service
We work to keep Formelia continuously available, but interruptions can happen due to maintenance, incidents or causes beyond our control. Current plans do not include a service level agreement (SLA).
We may add, modify or remove features. If we remove something material to your paid plan, we will give you reasonable notice so you can decide, including cancelling.
Features marked as beta, preview or experimental are offered without additional warranties, may change or be withdrawn at any time and may have their own limits; their withdrawal is not considered a material reduction of the plan.
No warranties
Formelia is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not warrant that the service will be uninterrupted or error-free. Nothing in this section limits warranties that the law of your country grants you as non-waivable.
Limitation of liability
To the maximum extent permitted by law: (a) neither party will be liable for indirect, incidental, special or consequential damages, nor for lost profits or loss of data not caused by our breach; and (b) Formelia's total liability for all claims related to the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim or, if you use the Free plan, to 50 USD.
These limits do not apply where prohibited by law, nor to damages caused by Formelia's willful misconduct or gross negligence.
Indemnification
If a third party brings a claim against Formelia arising from your content, your forms or a use of the service that violates these terms or the law, you will defend and indemnify us for the damages and reasonable costs (including legal fees) resulting from that claim. We will notify you of the claim and will not settle it by imposing obligations on you without your reasonable consent.
Suspension and termination
- You can stop using Formelia and request deletion of your account at any time.
- We may suspend or terminate your account if you violate these terms, if the law requires it, or if your use puts the service or others at risk. Except in severe cases, we will notify you and give you a chance to remedy.
- After termination you will have 30 days to export your content, unless the law or the severity of the case prevents it. Afterwards, it will be deleted according to the Privacy policy.
- Sections that by their nature should survive (content, liability, indemnification, governing law) remain in force after termination.
Changes to these terms
We may update these terms. If a change is material, we will notify you by email or in the app at least 30 days before it takes effect. If you keep using the service after that date, we take it that you accept the new version; if you disagree, you can cancel before it applies.
Governing law and dispute resolution
These terms are governed by the laws of the country where Formelia's operator has its legal domicile, without affecting non-waivable consumer protections of the country where you reside. Before starting any formal action, both parties will try to resolve the dispute in good faith: write to legal@formelia.io describing the problem and we will seek a solution within 30 days.
General provisions
- These terms, the Privacy policy and the pricing page form the entire agreement between you and Formelia regarding the service.
- If any provision is found invalid, the rest remains in force.
- Not enforcing a right at a given time does not mean we waive it.
- You may not assign this agreement without our consent; we may assign it in a reorganization or sale of the service, with notice to you.
- This agreement grants no rights to third parties. In particular, the respondents of your forms are not a party to it; their relationship regarding the data they submit is with you as the controller of the form.
- Neither party will be liable for delays or failures caused by events beyond its reasonable control, except for payment obligations already accrued.
- This document is published in Spanish and English; in case of conflict between versions, the Spanish version prevails.
